More than 60% of the people in prison are now racial and ethnic minorities. For Black males in their twenties, 1 in every 8 is in prison or jail on any given day. These trends have been intensified by the disproportionate impact of the “war on drugs,” in which three-fourths of all persons in prison for drug offenses are people of color.
Incarceration is not an equal opportunity punishment
On December 31, 2005, there were 2,193,798 people in U.S. prisons and jails. The United States incarcerates a greater share of its population, 737 per 100,000 residents, than any other country on the planet. But when you break down the statistics you see that incarceration is not an equal opportunity punishment.
U.S. incarceration rates by race, June 30, 2006:
Whites: 409 per 100,000
Latinos: 1,038 per 100,000
Blacks: 2,468 per 100,000
Gender is an important “filter” on the who goes to prison or jail, June 30, 2006:
Females: 134 per 100,000
Males: 1,384 per 100,000
Look at just the males by race, and the incarceration rates become even more frightening, June 30, 2006:
White males: 736 per 100,000
Latino males: 1,862 per 100,000
Black males: 4,789 per 100,000
If you look at males aged 25-29 and by race, you can see what is going on even clearer, June 30, 2006:
For White males ages 25-29: 1,685 per 100,000.
For Latino males ages 25-29: 3,912 per 100,000.
For Black males ages 25-29: 11,695 per 100,000. (That’s 11.7% of Black men in their late 20s.)

Sad, but so true. I appreciate the awareness that this site is bringing to this situation in our community. And I urge everyone to really take a look at what’s going on around us…incarceration is NOT an equal opportunity punishment. We are not the only ones committing crimes, but we seem to be the face of the inmate population. Why is that? But more importantly, what do we do about that. This system is so twisted, and corrupt….Even the treatment of our black men who are locked up is overlooked..they overcrowd the jails and have them sleeping on the concrete floor. What do we do about this? ~~~But before even start tackling that, we need to look at ourselves….how many of you walk around speakin’ of the love for your locked up loved one, but you don’t visit, using the excuse “I got warrants”, so if u do, why don’t you write….Unless you’ve been there yourself, you just don’t know what a letter from home can do, what kind of strength that gives a man, to know that through it all, somebody’s waiting for you. When my baby (my first love) was locked up, the people he was feeding and taking careof when he was on these streets, they all got ghost. They didnt visit, they put him on hold when he called….you truly find out how geniune a person is in times like those…So lets start with us…lets get it right, then we can get them (the system) right.

Its me again Just becuz this is plies site i gotta drop two responses to touch on the subject a little more, if it was the total opposite it would be wonderful but more black men in jail then in college is a shame, its said for various reason some blame where they come from the parents they didnt have there surrounding, and things couldnt change but to me that would take 2 arms and both legs to change the whole ya dig about more than half of the offenders to stay out because its so many hard heads out here its like they get out and the people tell them what not to do how to stay out and they get out and do the exact same things they told them not to do to keep em away from prisonor, and the first thing they say its a day to day struggle to stay out in the streets becuase its so hard to find a good job with a serveral records. gettin out doing the same thing would only make things more harder on them and sometime i wonder do they understand that. ITs sad but painfully true. The main problem is that a lot of people get caught up in fads and trends. They look at whats happenin right now and not to the future. A lot of black people are followers and lack a mind of leadership and independence. That being said they just follow the crowd and do what they see every body else is doing. If the hot thing is wearing Bathing Apes, etc. they all trying to get it. Always spending money we aint even got, just to keep up with the next man. A lot of them dont know about equity, assets, investing, saving…….they refuse to look at the bigger picture. The saying, “It gets greater later” holds a lot of weight. One can see the fruits of their work later, that same one has to understand the labor of the fruits is going to major, its going to be hard and its gon take long. Everybody is looking for the easy way out, there is no EASY was OUT. Trying to fly through this life on bullshit, you will never get out. Success doesnt lie in your clothes or how sexy you are. Its about where your mind is and what you can produce with it. One has to find out their self-worth and then they will soon learn their value to their family, to the world. No one wants to have to struggle but its a struggle to get what you positively deserve. Aint nobody GIVING you nothin out here, its going to take one to be ablel to bring something of value to the table. Something that sets you a part from the crowd. Black men have gotten caught up sad to say in being a dope boy, they glorify being able to say they was “trappin’”, that they were locked up, that they took somebody’s life and thats sad. Dont none of that make them no man. Ive noticed that a Black men dont see the err in their ways or a need for change until they are locked up, somebody tries to take their life or they took someone else’s life. Why does it have to be that? Why do they have to lose so much? Too gain real substantial knowledge. It so much wasted talent in these jails and its killin me. I loathe the fact that they want to call these jails rehabilitation centers, please. A lot of time, our men come out feeling so weak, so lost, some times so violated. All the jails do is change these men into angry, vengeful people. Where is the rehabilitation? Its coming now to the point we women, have to take the position of these men and help them to rebuild themselves inside and out when they come home. And if we not on our all the way on our feet when they touch down, then they feel like I gotta make somethin happen right now. So they start hitting the streets hard because its quick, fast and easy. They start grindin so hard that they dont have time to look for a safe, decent job. Its a sick ass circle of destruction. We can turn it all around and not get caught up in the society’s trap. Your article is definitely on time. All Black Mothers in Washington, DC are greatly impacted as well by their son(s) being incarcerated for long durations outside of our city. Our city is considered by native washingtonians to be “the last colony”. This is primarily due to our current status of having no voice in the Congress and Senate which has compacted the plight of our children’s cruel and unjust punishment via the Bureau of Prison (BOP) which allows for our young men to be incarcerated and housed in the Bureau of Prison institutions and penitentiaries which are located throughout the country.
We are the only jurisdiction in the USA that has “taxation without representation” which equals to no voting rights over those non-DC legislators who govern our ciities’ budget, as well as local governmental operations (city council, Mayor, School, etc). We must seek approval from out of state congressman and senators in all of our city matters. Yes, that is right, slavery does still exist - just take a look at Washington, DC!!!!!!!!!!!!
We are a jurisdiction that does not have our own local city correctional facility. Our young men find themselves often being denied visitations from their immediate family members by them being incarcerated for more than 100 miles away. We, mothers of conviction, are unable to advocate on behalf of our sons on a regular basiis. We have to undergo the financial hardship of purchasing train, airplane or driving long distances to see our sons and have often been turned away once we arrive because our children’s visitation rights being suddenly been taken away for some unknown reason.
It is well known throught the Black community, that the Black male is being incarcerated by design. The powers of our country have continued their racist underhanded tactics of burdening the Black family by strengthening their resolve to remove our sons to out of state rural institutions as a means to economically sustain the white controlled rural communities of the USA. All the while, they prepare the sons of these men to be left home without the much needed guidance of their fathers. This has led to an overwhelming increase in juvenile arrest and confinement.
But there are several mothers like myself, who have stepped up to the plate locally to advocate on behalf of our incarcerated grandsons, nephews and neighborhood childen alike, to ensure that they do not easily end up being shipped out of our city as young adult prisoners.

I have a couisin locked up for murder.u remind me of him(LOOKS!)Except he has green eyes like a cat.He was my best friend what ever he did I was the first to know.He would break in places steal and show off.thats what he did.If he got locked up it was only a matter of hours before he would escape.Never hurt anybody hes being doing this all his life.This all changed in 94.He was serving a three year sentence in Macon,ga for burglary. he exscaped came to Griffin,ga found me I already knew he had escaped thats what he do.A couple days pass a murder take place.gunshot kidnapping of about 6 people,and rape.And because he had escaped he got charged for it .no murder weopon,DNA finger prints nothing.they talked this one individual to say this guy that did this had funny color eyes.YES he got convicted for the color of eyes says its very rare for black men to have those color of eyes. The after-hours club was known only to an inner circle. “Scorpio,” an ex-con turned informant, was secretly running it for the FBI. Then, four killings suddenly blew the operation’s cover โ and ultimately raised constitutional questions in a Paterson courtroom.
The FBI’s resistance to answering certain questions on the witness stand about its surveillance of the Paterson club presented a unique problem for the trial judge and attorneys in the David Baylor murder trial. Which outweighs which: the FBI’s legal right to conceal sensitive information about its undercover investigations or the defendant’s Sixth Amendment right to cross-examine witnesses?
Though a compromise was ultimately reached, the distinct risk of a mistrial loomed over the high-profile case that took more than two years to come to court.
WITNESSES WHO TESTIFIED
Among state’s witnesses who testified in the David Baylor quadruple murder trial were:
Lorenzo Gonzalez, also known to patrons of the club as Scorpio, who testified in vivid detail about becoming an FBI informant who ran the club at great risk to himself for the betterment of society. He complained that the FBI never paid him all it promised, and that the agency has given him virtually no special protection since the murders that blew the undercover cooperation. He said he saw Baylor open fire in the club that night.
Beatriz Hernandez, a 24-year-old co-defendant originally charged with felony murder who pleaded guilty to attempted robbery. Hernandez, a 24-year-old mother of three who admitted to being a former drug dealer and gang member, testified she hatched the idea to rob the club that night but did not expect Baylor to open fire. She said she watched, shocked, as he shot the victims before she ran out of the club and provided the getaway car for Baylor and others.
“It’s an issue of serious magnitude,” said Chatham-based criminal trial attorney Alan Zegas, who recently served as defense counsel in the fraud and conspiracy trial of former Newark Mayor Sharpe James. “I’ve never heard of anything close to that. I’ve seen the FBI attempt to resist coming in. But I’ve never heard of a case where the FBI comes in, testifies for the prosecution, and then asserts itself blanket immunity. That is wrong.”
Having FBI agents called to testify in trials isn’t unusual, he noted. “There is a procedure under federal law for subpoenaing FBI agents. They certainly testify in court,” he said. Ultimately, the judge must do a balancing test between the relevance of certain information to the trial at hand and the importance of that information remaining secret. But the judge decides โ not the FBI, he said.
“If it was highly relevant information, here would be a head-on collision,” said Philip Heymann, now a Harvard Law School professor and once assistant attorney general in charge of the Criminal Division for the U.S. Department of Justice in Washington, D.C. “If the judge thinks there is little harm being done by revealing the information and the government doesn’t want to reveal it, the government has to dismiss the case,” he said of what would happen in federal court.
But this is state Superior Court, in which federal agents are being called in to testify in a case being brought by county prosecutors.
“There’s a conflict in that there are two different jurisdictions. A federal judge has a lot of power to tell federal prosecutors what to do. But there is a lot of discomfort about a state judge telling federal prosecutors what to do.”
Had the judge ordered the agent to answer certain questions and she refused, she could have been held in contempt and put in jail. Ultimately, the conflict could have resulted in a mistrial. “But it doesn’t seem like it was all that relevant to the defense and it doesn’t seem like anything the FBI would have revealed would have compromised their operations, either,” Heymann added.
In trying to work out a solution that didn’t jeopardize the entire trial, state Superior Court Judge Ronald Marmo urged โ rather than ordered โ federal attorneys to allow the agent to answer at least certain reasonable defense questions so that the trial could move on.
Ultimately, that’s what happened. In addition, defense attorney Harley Breite said he would not ask the court to hold the agent in contempt or seek a mistrial if she refused to answer some of his questions. Instead, he asked the he to simply be allowed to ask his questions and have the agent invoke her privilege in front of the jury. The strategy was to show the jury that the FBI had something to hide in what may have really happened in the club that night.
Legal observers say that in this case, the system worked to everyone’s advantage. “It is a problem of potential constitutional magnitude, and it sounds like it’s being treated responsibly,” said longtime criminal defense attorney Carl Poplar, based in Cherry Hill. “The judge recognizes that there’s no absolute right for a witness, whether he’s an FBI agent or not, to not testify if it would have been essential for a fair trial,” he added. “To work out a compromise is the responsible way to go.”
The agent’s refusal to answer certain questions still may be basis for appellate arguments, he said. “But that’s secondary,” said Poplar said. “Your goal is to do your best case. You keep an eye on appellate issues. But you focus on the best way to win your case. You don’t try a case for the appeal. You try a case to win.”

The judge sentenced me which was violation of oath and genocide,treason,civil rights,human rights, sabotage, and etc.. I don’t know what TI is thinking , but I hope the body guards have their guns. RICO CRIMES
RICO stands for “Racketeer Influenced and Corrupt Organizations.” It is a law that is “designed to attack organized criminal activity and preserve marketplace integrity by investigating, controlling, and prosecuting persons who participate or conspire to participate in racketeering.” Black’s Law Dictionary 1286 (8th ed. 2005). The RICO Act was enacted in 1970, and applies only to activity involving interstate or foreign commerce. Id. “Racketeering” is defined in a couple of ways. In one way it is “a system of organized crime traditionally involving the extortion of money from businesses by intimidation, violence, or other illegal methods.” Id. In a second sense, it is a “pattern of illegal activity (such as bribery, extortion, fraud, and murder) carried out as part of an enterprise (such as a crime syndicate) that is owned or controlled by those engaged in the illegal activity.” Id. at 1287; see also 18 U.S.C. ยง 1961(1) (2007). This second sense is derived from the RICO statutes, found at 18 U.S.C. ยงยง 1961 et seq., and it has greatly broadened the term’s original understanding to include such violations as mail fraud, securities fraud, and the collection of illegal gambling debts.” Id. Because the RICO statutes are drawn so broadly, they have been applied in ways that Congress may not have intended. See Joseph Berger, Prosecutors to Present Clinic Doctor’s Slaying to Grand Jury, N.Y. Furthermore, the RICO statutes “provide for enforcement not only by criminal prosecution also by civil lawsuit, in which the plaintiff can sue for treble damages,” Id. at 1286, so there is great incentive to link as much activity to the RICO statutes as possible.
The Crime
18 U.S.C. ยง 1962 (2007).
Under this section, there are three different crimes that can be committed, plus an additional conspiracy provision.
Under section 1962(a), it is a crime for any person who has received any income derived from a pattern of racketeering activity or through collection of an unlawful debt in which such person has participated as a principal, to
use or invest, directly or indirectly, any part of such income, or the proceeds of such income,
in acquisition of any interest in, or the establishment or operation of, any enterprise which is engaged in, or the activities of which affect, interstate or foreign commerce. 18 U.S.C. ยง 1961(a).
Under section 1962(b), it is a crime for a person, through a pattern of racketeering activity or through collection of an unlawful debt,
to acquire or maintain, directly or indirectly, any interest in or control of any enterprise which is engaged in, or the activities of which affect, interstate or foreign commerce. Id. ยง 1962(b)
Under section 1962(c), it is a crime for a person employed by or associated with any enterprise engaged in, or the activities of which affect, interstate or foreign commerce, to
conduct or participate, directly or indirectly, in the conduct of such enterprise’s affairs through a pattern of racketeering activity or collection of unlawful debt. Id. ยง 1962(c)
Under section 1962(d), it is a crime for any person to conspire to violate any of the provisions of section 1962. Id. ยง 1962(d).
Exception
Section 1962(a) generally does not apply to a purchase of securities on the open market for purposes of investment, and without the intention of controlling or participating in the control of the issuer, if the securities of the issuer held do not amount in the aggregate to one percent of the outstanding securities of any one class, and do not confer, either in law or in fact, the power to elect one or more directors of the issuer.) 18 U.S.C. ยง 1962(a).
The Punishment
18 U.S.C. ยง 1963 (2007).
A violation of section 1962 can be punished by
a fine,
imprisonment for not more than 20 years, or
both. 18 U.S.C. ยง 1963(a).
If the violation is based on a racketeering activity for which the maximum penalty includes life imprisonment, then the violation can be punished by
a fine,
imprisonment for up to life, or
both. Id.
Furthermore, the violation will result in the forfeiture to the United States of
any interest the person has acquired or maintained in violation of section 1962. 18 U.S.C. ยง 1963(a)(1).

any property constituting, or derived from, any proceeds which the person obtained, directly or indirectly, from racketeering activity or unlawful debt collection in violation of section 1962. 18 U.S.C. ยง 1963(a)(3)
Furthermore, in lieu of a fine otherwise authorized by this section, a defendant who derives profits or other proceeds from an offense may be fined not more than twice the gross profits or other proceeds. 18 U.S.C. ยง 1963(a).
The remaining provisions of section 1963 concern forfeiture procedures.
